Fire safety inspection requirements in Italy

D.Lgs. 81/2008 Allegato IV punto 1.5 (vie e uscite di emergenza); DM 3 agosto 2015 (Codice PI) sez. S.4 (esodo)

STATUTARIO (D.Lgs. 81/2008 Allegato IV, punto 1.5): le vie di esodo e le uscite di sicurezza devono restare sgombre e disponibili, apribili nel verso dell'esodo senza chiave e con un solo movimento, rispettando le larghezze minime. È un dovere CONTINUO (non un intervallo periodico). I maniglioni antipanico devono essere efficienti.

STATUTORY (Legislative Decree 81/2008 Annex IV, point 1.5): escape routes and emergency exits must stay clear and available, openable in the direction of travel without a key and in a single action, keeping minimum widths. This is a CONTINUOUS duty (not a periodic interval). Panic hardware must be operative.

S.9): emergency lighting must be present where required, activate on failure of the ordinary supply and cover escape routes and exits with minimum illuminance and autonomy (>= 1 h). STATUTARIO (D.Lgs. 81/2008 Titolo V): la segnaletica di sicurezza relativa a vie di esodo, uscite e presidi antincendio deve essere presente, visibile e conforme, con segnali direzionali dove l'uscita non è direttamente visibile. I segnali grafici seguono la UNI EN ISO 7010 (norma).

STATUTORY (Legislative Decree 81/2008 Title V): safety signage for escape routes, exits and fire-fighting equipment must be present, visible and compliant, with directional signs where the exit is not directly visible. Graphic signs follow UNI EN ISO 7010 (standard).

STATUTARIO (D.Lgs. 81/2008 Allegato IV): i materiali combustibili e i depositi devono essere gestiti per contenere il carico d'incendio, mantenendo la separazione da sorgenti di calore, quadri elettrici e vie di esodo. Liquidi e gas infiammabili devono essere stoccati in modo conforme e in quantità non eccedenti quelle valutate.

Flammable liquids and gases must be stored compliantly and in quantities not exceeding those assessed.

STATUTARIO (D.Lgs. 81/2008 art. 46): il datore di lavoro deve effettuare la valutazione del rischio incendio quale parte integrante del DVR, classificare il livello di rischio e adottare le conseguenti misure di prevenzione, protezione e gestione dell'emergenza. La valutazione deve essere aggiornata a fronte di modifiche a layout, attività, impianti o mansioni. I criteri di progettazione/esercizio per i luoghi di lavoro sono fissati dal DM 3 settembre 2021.

STATUTORY (Legislative Decree 81/2008 art. 46): the employer must carry out the fire risk assessment as an integral part of the DVR (risk-assessment document), classify the risk level and adopt the resulting prevention, protection and emergency-management measures. The assessment must be updated whenever layout, activity, systems or roles change. The design/operation criteria for workplaces are set by DM 3 September 2021.

STATUTARIO come DOTAZIONE (D.Lgs. 81/2008 / DM 1 settembre 2021): gli estintori devono essere presenti in numero e tipo adeguati al rischio ove richiesti, accessibili, segnalati e carichi. La UNI 9994-1 prevede sorveglianza (a cura del datore, raccomandata con frequenza non superiore a quella mensile), controllo periodico almeno semestrale, revisione e collaudo a periodicità variabile secondo il tipo, eseguiti da tecnico manutentore qualificato. La UNI fissa il metodo/intervallo, il decreto la dotazione e il dovere.

STATUTORY as PROVISION (Legislative Decree 81/2008 / DM 1 Sept 2021): extinguishers must be present in the number and type suited to the risk where required, accessible, signed and charged. UNI 9994-1 sets surveillance (by the employer, recommended no less often than monthly), a periodic check at least every six months, and revision and pressure testing at type-dependent intervals, carried out by a qualified maintenance technician. The UNI fixes method/interval, the decree the provision and the duty.

STATUTARIO (D.Lgs. 81/2008): le sorgenti d'innesco (impianti e apparecchiature elettriche, superfici calde, fiamme libere) devono essere tenute sotto controllo. Gli impianti elettrici devono essere a regola d'arte, privi di sovraccarichi, surriscaldamenti o collegamenti provvisori; gli impianti di messa a terra sono soggetti a verifica periodica (DPR 462/2001, ogni 2 o 5 anni secondo il luogo).

STATUTORY (Legislative Decree 81/2008): ignition sources (electrical systems and equipment, hot surfaces, open flames) must be kept under control. Electrical installations must be sound, free of overloads, overheating or temporary connections; earthing systems are subject to periodic verification (DPR 462/2001, every 2 or 5 years depending on the premises).

MANUTENZIONE DI SISTEMA INSTALLATO (DM 1 settembre 2021 / DM 3 agosto 2015 sez. S.6): ove installato, l'impianto automatico di spegnimento (sprinkler ad acqua, a gas, a schiuma o ad acqua nebulizzata) deve restare in pressione/carico e operativo - valvole principali aperte e supervisionate, erogatori/ugelli liberi con la distanza libera richiesta, alimentazione idrica o riserva d'agente verificate - con controllo periodico secondo la UNI applicabile (UNI EN 12845 / UNI 11280 - norme).

MAINTENANCE OF AN INSTALLED SYSTEM (DM 1 Sept 2021 / DM 3 Aug 2015 sec. S.6): where installed, the automatic extinguishing system (water sprinkler, gas, foam or water mist) must stay pressurised/charged and operative - main valves open and monitored, heads/nozzles clear with the required clearance, water supply or agent reserve verified - with periodic checks per the applicable UNI (UNI EN 12845 / UNI 11280 - standards).

MANUTENZIONE DI SISTEMA INSTALLATO (DM 1 settembre 2021 / DM 3 agosto 2015 sez. S.8): ove installato, il sistema di evacuazione di fumo e calore (SEFC/ENFC, naturale o forzato) deve essere operativo - evacuatori e aperture liberi e manovrabili, comandi manuali e automatici efficienti, aperture di afflusso d'aria libere, alimentazione verificata - con controllo periodico secondo la UNI 9494 (norma).

MAINTENANCE OF AN INSTALLED SYSTEM (DM 1 Sept 2021 / DM 3 Aug 2015 sec. S.8): where installed, the smoke and heat exhaust system (SHEV, natural or powered) must be operative - exhaust vents and openings clear and operable, manual and automatic controls efficient, air-inlet openings clear, power supply verified - with periodic checks per UNI 9494 (standard).

DM 1 settembre 2021 (registro dei controlli antincendio; criteri generali per il controllo e la manutenzione degli impianti, attrezzature e altri sistemi di sicurezza antincendio); DPR 151/2011 (obbligo di registro per le attività soggette)

STATUTARIO (DM 1 settembre 2021): il registro dei controlli antincendio deve essere istituito, tenuto aggiornato e reso disponibile in sito, con annotazione dei controlli periodici, degli interventi di manutenzione, delle prove e del relativo esito. La manutenzione dei sistemi di sicurezza antincendio deve essere eseguita da tecnici manutentori qualificati e le non conformità rilevate devono essere tracciate e risolte.

STATUTORY (DM 1 Sept 2021): the fire-safety control register must be set up, kept current and available on site, recording periodic checks, maintenance interventions, tests and their outcome. Maintenance of fire-safety systems must be carried out by qualified maintenance technicians and any non-conformities found must be tracked and resolved.

DM 2 settembre 2021 (criteri per la gestione della sicurezza antincendio in esercizio ed in emergenza; formazione e aggiornamento degli addetti, livelli 1/2/3); D.Lgs. 81/2008 artt. 18, 37 e 43

STATUTARIO (DM 2 settembre 2021 - GSA): il datore di lavoro deve organizzare la gestione della sicurezza antincendio in esercizio ed in emergenza (piano di emergenza ove richiesto, designazione degli addetti al servizio antincendio) e garantire la formazione e l'aggiornamento periodico degli addetti in funzione del livello di rischio (percorsi 1/2/3). Le prove di evacuazione vanno effettuate ove previste.

STATUTORY (DM 2 Sept 2021 - GSA): the employer must organise fire-safety management in operation and emergency (emergency plan where required, appointment of fire-service wardens) and ensure the training and periodic refresher of wardens according to the risk level (level 1/2/3 courses). Evacuation drills must be carried out where required.

DM 3 agosto 2015 (Codice PI) sez. S.2 (resistenza al fuoco) e S.3 (compartimentazione); DM 16 febbraio 2007 (classificazione di resistenza al fuoco); EN 13501-1 (reazione al fuoco)

STATUTARIO come PROTEZIONE PASSIVA (DM 3 agosto 2015 sez. S.2-S.3): gli elementi di compartimentazione (pareti e solai REI, porte tagliafuoco, sigillature degli attraversamenti impiantistici) devono essere integri e funzionanti; i materiali devono avere adeguata reazione al fuoco (classificazione EN 13501-1). Le porte REI devono essere dotate di autochiusura efficiente e non tenute aperte in modo improprio.

STATUTORY as PASSIVE PROTECTION (DM 3 Aug 2015 sec. S.2-S.3): compartmentation elements (REI walls and floors, fire doors, sealing of service penetrations) must be intact and functional; materials must have adequate reaction to fire (EN 13501-1 classification). REI doors must have efficient self-closing and must not be improperly held open.

DPR 151/2011 artt. 3-4 (SCIA antincendio per le attività dell'Allegato I, cat. A/B/C) e art. 5 (attestazione di rinnovo periodico di conformità antincendio ogni 5 anni; 10 anni per le attività 6, 7, 8, 64, 71, 72 e 77 dell'Allegato I)

STATUTARIO per le attività soggette (DPR 151/2011, Allegato I): l'attività deve avere presentato la SCIA antincendio al Comando dei Vigili del Fuoco e, dove prevista l'autorizzazione, aver assolto gli adempimenti di categoria (verifica in loco per la cat. C). L'attestazione di rinnovo periodico di conformità antincendio (art. 5) va presentata ogni 5 anni (10 anni per le attività 6, 7, 8, 64, 71, 72 e 77). Le modifiche che incidono sulla sicurezza antincendio richiedono nuova SCIA.

STATUTORY for regulated activities (DPR 151/2011, Annex I): the activity must have filed the SCIA (fire-safety certified commencement notice) with the Fire Brigade Command and, where required, met its category obligations (on-site inspection for cat. C). The periodic fire-conformity renewal attestation (art. 5) is due every 5 years (10 years for activities 6, 7, 8, 64, 71, 72 and 77). Changes affecting fire safety require a new SCIA.
